Two defendants who appeared in Barton County District Court on Monday, April 11, were sentenced to prison, County Attorney Levi Morris said.
Dustin Sullivan was in court for sentencing. A Barton County jury convicted Sullivan on October 14, 2021, of distribution of methamphetamine in Barton County criminal case 19 CR 471 and distribution of methamphetamine and no drug tax stamp in Barton County criminal case 20 CR 123. These two cases were consolidated for trial purposes.
In both cases, Sullivan filed motions asking the court for probation. After hearing the arguments of defense counsel Don Anderson and Barton County Attorney Morris, District Court Judge Carey Hipp denied the request for probation. In 19 CR 471 Sullivan was sentenced to 117 months (nine years and nine months) in the Kansas Department of Corrections. In 20 CR 123, Sullivan was sentenced to 65 months (five years and five months) in KDOC custody plus 5 months for the No Tax Stamp conviction.
Clifford Parkins was back in District Court on allegations that he violated the terms and conditions of his probation. Parkins was on probation in Barton County cases 19 CR 221 and 20 CR 228. The State of Kansas, represented by Barton County Attorney Morris, presented evidence to the court that Parkins had violated his probation by committing a new crime. After hearing evidence, as well as the arguments of defense counsel Ben Fisher, District Court Judge Hipp found that Parkins had violated his probation by committing a new crime, revoked the probation, and ordered Parkins to serve 144 months (12 years) in the Kansas Department of Corrections.
